Terms of Service

These terms govern your use of Now Playing Utah, operated by the Utah Cultural Alliance (a 501(c)(4) organization) and the Utah Cultural Alliance Foundation (a 501(c)(3) organization). By using the site or buying a membership, product, or donating, you agree to these terms.

Accounts

You are responsible for keeping your login secure and for activity under your account. Provide accurate information and keep it current.

Purchases and pricing

Prices are shown at checkout in U.S. dollars. We may correct pricing errors and update offerings at any time. Payment is processed by Stripe; by paying you agree to Stripe’s terms as well.

Memberships and renewals

Memberships purchased on a recurring basis renew automatically at the then-current rate until cancelled. You can cancel future renewals from your account or by contacting us; cancellation stops the next renewal and does not retroactively refund the current term unless required by law.

Payment by check or invoice

Where offered, orders placed by check or invoice are reserved but not confirmed until payment is received. We may release a reservation if payment is not received within the stated terms.

Donations

Donations are voluntary. Gifts to the Utah Cultural Alliance Foundation (501(c)(3)) are tax-deductible to the extent allowed by law; gifts to the Utah Cultural Alliance (501(c)(4)) are not deductible as charitable contributions. Keep your emailed receipt for your records.

Refunds and cancellations

To cancel or change an order, email npusupport@nowplayingutah.com with your order number. Approved refunds go back to the original payment method and usually appear within 5–10 business days. Orders paid by check are refunded by check.

Advertising

Advertising is sold by the week, and each placement has a limited number of spots. For each booked week:

• 7 or more days before the week begins: you may cancel for a full refund, or move the booking to another open week at no charge.
• Fewer than 7 days before the week begins: the booking is non-refundable. Where another week is open, we will move the booking once at no charge.
• After the week has begun: the booking cannot be cancelled, moved, or refunded.
• Artwork: ad files that meet our published specifications are due at least 3 business days before the run begins. If artwork arrives late, the ad runs for the remainder of the booked week once it is ready; the missed days are not refunded or credited.
• Content review: we may decline or remove advertising that does not meet our specifications or content standards. If we decline an ad and you do not supply a suitable replacement, we will refund that booking in full.
• If we cannot run your ad because of an error or outage on our side, you may choose a replacement week of equal value or a refund for the affected portion.
• Orders with several weeks: these rules apply to each week separately, so later weeks can still be cancelled or moved after earlier ones have run.
• Check or invoice orders: an unpaid reservation can be cancelled without charge any time before its week begins.

Memberships

Membership dues are non-refundable once a term has started, and cancelling does not refund the current term. If a membership renewed automatically and you did not intend it to, contact us within 14 days of the renewal charge and we will cancel the membership and refund that charge.

Calendar exports and other digital products

Digital products are non-refundable once access has been delivered, unless we are unable to provide the service.

Donations

Donations are non-refundable. If a gift was made in error — a duplicate charge or the wrong amount — contact us within 30 days and we will correct it.

Acceptable use

Don’t misuse the service: no unlawful activity, no attempts to breach security or access others’ accounts, and no interference with the site’s operation.

Intellectual property

Content on this site is owned by us or our licensors and may not be copied or redistributed without permission, except as the site’s features expressly allow.

Disclaimers and limitation of liability

The service is provided “as is” without warranties of any kind. To the fullest extent permitted by law, we are not liable for indirect or consequential damages, and our total liability for any claim is limited to the amount you paid us for the item giving rise to the claim.

Governing law

These terms are governed by the laws of the State of Utah, without regard to conflict-of-laws rules.

Changes

We may update these terms; continued use after changes means you accept them. See the “last updated” date above.
